Data Protection Notice (KVKK)

This is an English translation for convenience. If the two differ, the Turkish text prevails.

This notice is given under Article 10 of the Turkish Personal Data Protection Law No. 6698 ("KVKK") to inform you about the personal data processed through the Biosportive app, web panel and biosportive.com website. The detailed list of data is on the Privacy Policy page.

1. Data controller

The data controller is Furkan Doğan (a natural person). Contact: info@furkandogan.com.

2. Personal data processed

  • Identity and contact: full name, e-mail, phone, date of birth, sex, city, profile photo.
  • Special category data (health): activity, heart, breathing, sleep, workout and nutrition records read from Apple Health; the pulse signal and HRV measured with the camera; morning and evening check-ins, soreness reports; medical diet, allergy and intolerance statements.
  • Visual records: training videos showing the face and body, meal photos.
  • Audio records: voice notes left for the dietitian.
  • Performance data: movement measurements calculated from videos, workout logs and difficulty ratings.
  • Transaction security: session details, device token, IP address.

3. Purposes

  • Monitoring of the athlete's training load, recovery and performance by the club's conditioning staff, and feedback to the athlete,
  • nutrition follow-up for users who work with a dietitian,
  • scientific research and improvement of measurement methods,
  • account management, notifications and user support,
  • information security and prevention of misuse.

4. Legal grounds

  • Health data, visual and audio records: your explicit consent (KVKK Art. 6). Explicit consent is obtained through the consent text in the app before you start using it, and asked again whenever the text changes.
  • Identity and contact data: establishing and performing the service relationship (KVKK Art. 5/2-c).
  • Transaction security data: the controller's legitimate interest (KVKK Art. 5/2-f) and legal obligations (KVKK Art. 5/2-ç).

5. Method of collection

Your personal data is collected electronically through the mobile app and the web panel: from what you enter, from Apple Health to the extent you allow, from your phone's camera, from the files you upload, and from the club or dietitian who opened your account.

6. Transfers

Your personal data may be transferred, limited to the purposes above, to:

  • the conditioning staff of the club you belong to,
  • the dietitian you work with (only the Apple Health groups you choose to share),
  • the server hosting provider in Türkiye,
  • Apple and Expo, located abroad, for notification delivery and app updates (device token, notification text and IP address only),
  • Vercel, located abroad, for hosting the web panel and the website (page requests and IP address only),
  • competent public authorities where the law requires it.

Research results are shared only in aggregate and without identity.

7. Retention

Videos and measurements are kept indefinitely. When you close your account your identity is deleted; your records continue to be kept without your identity for research. Details are on the Account Deletion page.

8. Your rights (KVKK Art. 11)

By applying to the data controller you may:

  1. learn whether your personal data is processed,
  2. request information if it has been processed,
  3. learn the purpose of processing and whether data is used in line with that purpose,
  4. know the third parties in Türkiye or abroad to whom data is transferred,
  5. ask for correction if data is incomplete or inaccurate,
  6. ask for deletion or destruction under the conditions in KVKK Art. 7,
  7. ask that the actions under items 5 and 6 be notified to third parties to whom data was transferred,
  8. object to an outcome against you that arises solely from automated analysis of your data,
  9. claim compensation if you suffer damage because of unlawful processing.

9. How to apply

Send your request from the e-mail address registered to your Biosportive account to info@furkandogan.com. State your full name, contact details and request clearly. Requests are concluded free of charge within 30 days at the latest. If your request is refused, the answer is insufficient or no answer is given in time, you may complain to the Turkish Personal Data Protection Board.

In the app you can download your data (Profil › Veri ve gizlilik › Verilerimi dışa aktar) and close your account (Profil › Veri ve gizlilik › Hesabımı kapat).
